Enbridge Wins Federal Permit for Line 5 Tunnel

Army Corps approves tunnel project, but Michigan state court remains a roadblock.

The U.S. Army Corps of Engineers has granted a key federal permit for Enbridge's proposed tunnel under the Straits of Mackinac to carry crude oil from Canada to the U.S. Midwest. However, a Michigan state court has signaled it may block the project on state environmental grounds, creating a legal standoff.

Federal permit clears the way, but Michigan courts threaten to block Enbridge's tunnel, leaving the project in legal limbo.

Enbridge Inc. (ENB, Canadian-listed but trades on NYSE) is the direct beneficiary if the tunnel is ultimately built; the project would secure long-term crude transport revenue and reduce regulatory risk. TC Energy (TRP, also Canadian but NYSE-listed) faces reduced competition for Canadian crude exports if Enbridge's line is blocked. Midwestern refiners—including Valero Energy (VLO), Phillips 66 (PSX), and Delek US Holdings (DK)—benefit from stable crude supply via the tunnel, which could lower feedstock costs if it replaces more expensive alternatives.

The risk is that Michigan's state court blocks the project on environmental or tribal grounds, stranding Enbridge's investment and forcing the company to pursue alternative routes or abandon the expansion. Tribal nations and environmental groups have sued to stop the tunnel, and Michigan's courts have shown willingness to side with them. If blocked, crude supply to Midwest refiners tightens, raising feedstock costs and pressuring margins.

Watch for: Michigan state court rulings on the tunnel's legality; any appeals to the U.S. Supreme Court; Enbridge's quarterly earnings and guidance on the project timeline.
