Trump Kills Affirmative Action Rules—Contractors Face Compliance Shift

Rescission of EO 11246 removes diversity requirements for federal contractors.

On January 21, 2025, President Trump revoked Executive Order 11246 via Executive Order 14173, and the Labor Department finalized the rescission on August 18, 2026. The move eliminates longstanding diversity and affirmative action requirements for federal contractors, including goals for hiring women and minorities.

Rescission of affirmative action rules cuts compliance costs for federal contractors—but threatens diversity staffing firms and MWOBE access to federal dollars.

Beneficiaries are large federal contractors that previously incurred compliance costs and potential penalties for missing diversity targets. Lockheed Martin LMT, Raytheon Technologies (RTX), General Dynamics GD, and Boeing BA reduce administrative overhead and legal exposure. Smaller defense and IT contractors also benefit from lower compliance burdens. However, the financial impact is modest—most large contractors already met or exceeded diversity targets, so the savings are primarily in compliance staffing and audit costs, not material to earnings.

At risk are diversity-focused staffing and consulting firms that helped contractors meet EO 11246 targets. Companies like Kforce (KFRC) and On Assignment (ASGN) may see reduced demand for diversity recruitment services. Minority-owned and women-owned business enterprises (MWOBEs) that relied on federal contracting set-asides face reduced preferential access to federal dollars.

Watch for Q4 2026 earnings calls from major defense contractors. If they cite compliance cost reductions, the market will price in modest margin expansion. If federal agencies challenge the rescission in court, uncertainty will persist.
