New Jersey's Nuclear Energy Law Opens a Real Revenue Path for Small Reactor Developers

The 'Power NJ Act' creates a state-level procurement framework for advanced nuclear — the first concrete offtake signal for SMR developers in the Northeast.

New Jersey's governor signed the Power NJ Act, legislation designed to support the development of advanced nuclear energy in the state. The law creates a framework for procuring power from advanced nuclear technologies, including small modular reactors (SMRs), giving developers a clearer path to offtake agreements in one of the most power-constrained and data-center-dense states in the country.

New Jersey just gave SMR developers the one thing they've been missing: a state willing to sign a check for power that doesn't exist yet.

Who cashes in: NuScale Power SMR is the only U.S.-listed SMR pure-play and is the most direct beneficiary of any state-level procurement framework — New Jersey's law is exactly the kind of policy signal NuScale needs to attract utility partners and project financing. Oklo OKLO, which went public via SPAC and is developing microreactors, also benefits from the broader regulatory normalization. Constellation Energy CEG, which operates existing nuclear plants in the PJM grid region that includes New Jersey, benefits from any policy that raises the value of carbon-free baseload power in the state. Uranium miners like Cameco CCJ and Energy Fuels UUUU benefit from any demand signal that makes new nuclear construction more credible.

Who's exposed: Natural gas peakers and merchant gas generators in the PJM region face long-term displacement if SMRs actually get built and dispatched as baseload. That's a 10-plus year horizon, but it's a ceiling on new gas capacity investment in the region. Utilities that have been planning gas-fired data center power solutions in New Jersey face a potential policy headwind if nuclear procurement gets priority treatment.

What to watch next: Whether New Jersey's utility commission issues an RFP under the new law and which technologies qualify. An RFP that explicitly includes SMRs is the catalyst that moves NuScale. Also watch whether other Northeast states — Connecticut, Pennsylvania — follow with similar legislation, which would create a regional demand signal large enough to actually finance a first-of-kind SMR project.
